Park Legal Terms of Use and Privacy Policy
Acceptance of Terms and Conditions
By utilizing any services provided by Skyway Park, including, but not limited to, parking at our facilities and use of our online platforms (collectively referred to as “Services”), you (“Customer”) acknowledge and agree to be bound by the terms and conditions set forth in this document, which includes terms on the parking ticket issued at check-in. These Terms constitute a legally binding contract between you and Skyway Park (referred to as “Company,” “we,” or “us”).
Privacy Policy and Personal Information
Skyway Park is committed to protecting your privacy. Personal information collected during the course of providing our Services, including but not limited to your name, email address, and vehicle details, will be used solely for purposes directly related to service provision, such as processing parking reservations, facilitating communications, and enhancing the customer experience.
Personal data may be stored securely but will not be sold or shared with third parties for marketing purposes without explicit Customer consent. Customers may request the removal of their personal data from our records by submitting a formal request via email to customer.service@skywaypark.ca. Skyway Park will take reasonable measures to accommodate such requests, subject to legal and operational requirements.
Changes to Privacy and Terms of Use Policies
Skyway Park reserves the right to modify or update these terms and its privacy policy at any time without prior notice. Such changes will be posted on our website, and continued use of our Services after changes have been posted constitutes acceptance of the revised terms.
Indemnity and Liability Limitations
Skyway Park and its affiliates shall not be liable for any loss, theft, or damage to vehicles or their contents while parked at our facilities, regardless of the cause, including but not limited to acts of vandalism, theft, weather-related events, or other incidents. Customers park at their own risk and are encouraged to remove valuables from their vehicles. The Customer agrees to indemnify and hold harmless Skyway Park from any claims, damages, or expenses arising out of the use of the parking facilities.
This limitation of liability is prominently displayed at our facilities and forms part of the binding contract agreed upon at check-in. The terms and conditions provided on the parking ticket reinforce this indemnity clause.
Intellectual Property Rights
All content on the Skyway Park website, including but not limited to logos, designs, text, images, and software, is the exclusive property of Skyway Park and is protected by applicable copyright, trademark, and intellectual property laws. Unauthorized use, reproduction, or distribution of any material found on our website or associated with our Services is strictly prohibited and may result in legal action.
Non-Disparagement Policy
Skyway Park values respectful and constructive interactions with its Customers. While we encourage honest and open feedback regarding our Services, any Customer who engages in abusive, defamatory, or hostile behavior, including but not limited to inappropriate language or threats toward Skyway Park staff or representatives, either in person or via online platforms, may have their rights to refunds, benefits, or other acts of goodwill revoked at the sole discretion of Skyway Park.
This Non-Disparagement Policy does not limit a Customer's right to freely express opinions or review our Services in good faith, but it does clarify that Skyway Park reserves the right to refuse refunds, benefits, compensation, or any further engagement with Customers whose behavior violates this policy. Additionally, Skyway Park shall not be obligated to become a party to any legal or insurable actions initiated by such Customers.
Force Majeure
Skyway Park shall not be held liable for any delays, interruptions, or failure to provide Services resulting from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, strikes, or government actions.
Amendments to Terms and Conditions
Skyway Park reserves the right to amend, modify, or discontinue any aspect of these terms and conditions, including but not limited to pricing, policies, or procedures, at its sole discretion and without prior notice. Any amendments will be posted to our website, and Customers are advised to review the terms regularly to ensure compliance. The Customer’s continued use of Skyway Park’s facilities after such amendments constitutes acceptance of the revised terms.
Governing Law and Jurisdiction
These terms and conditions shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising out of or related to these terms shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada.
Severability
If any provision of these terms is found to be unlawful, void, or for any reason unenforceable, that provision shall be deemed severable from the rest of the terms and shall not affect the validity and enforceability of any remaining provisions.
